Indonesia Prepares Convict Transfer Agreement

VIVAnews - The Indonesian government is still preparing the agreement on trans-national convict transfer. Minister of Justice and Human Rights, Andi Mattalatta, stated that the issue is still being discussed internally.

Mattalatta said eight issues are being weighed including "Who [committed the crime] and what crimes have been committed," he told reporters on Monday, Feb. 23.

In addition, the rights and authorities of the country transferring the convicts as well as destination country should also be discussed. "Not to mention the standards applied in various countries," said Mattalatta. Every country, he said, has different ways of implementing the standards.

If the discussion is completed, he went on to say, then the legal umbrella will be shortly prepared. "[It aims at] a transnational mutual legal assistance," said Mattalatta. Similar issue has been applied in the extradition agreement.

A month ago, said Mattalatta, Netherlands Minister of Foreign Affairs requested the transfer of 10 Dutch citizens to the Netherlands. Two out of the proposed amount included death convicts.

In response to the visit made by Netherlands Minister of Justice Ernst Hirsch Ballin to Jakarta today, Mattalatta said the memorandum of understanding did not focus on the issue. 

He suggested the Dutch government solve the issue through a government-to-government mechanism. "Take a diplomatic path," he said.
