Use of Online Administration System Objected

VIVAnews – PT Sarana Rekatama Dinamika is no longer the partner of the Department of Justice and Human Rights in running the legal entities administration system (sisminbakum). The Department is planning to find another partner for the system. Sarana Rekatama is disputing the Department’s continued use of the online administration system using the existing tools that have been used when it was still the Department's partner.

According to Hotma Sitompoel, legal advisor of PT Sarana Rekatama, Hotma  the contract can be terminated only after a new agreement is created.

"Although the contract has been terminated, there still has to be an agreement by the third party in the cooperation, which is Sarana Rekatama,” said Sitompoel, Saturday, Jan. 24. “This is in accordance with the law,” he continued.

Therefore, said Sitompoel, the Department cannot use any of the sisminbakum tools that have been used in conjunction with PT Sarana Rekatama without obtaining its approval.

The Department of Justice and Human Rights is currently still running the administration system without a partner, after the decision to terminate the contract with PT Sarana Rekatama sometime ago.

The Attorney General’s Office has named President Director of PT Sarana Rekatama, Yohanes Waworuntu, as a suspect in the alleged corruption case stemming from the online administration system.

Meanwhile, Febri Diansyah, researcher for the Indonesian Corruption Watch (ICW), said that a new agreement between the two parties is not necessary. “If there was to be a new agreement, it would be an addendum or an amendment,” said Diansyah to VIVAnews.

Diansyah explained that whenever there is a termination of contract or agreement then the process must start from the beginning again. "The opportunity should open to other companies," he said

Diansyah also stated that usually the cancellation of a contract is based on the consent of both parties. “Unless there is a special clause. I myself haven’t read the contract,” he said.

Sarana Rekatama has invited the Department of Justice and Human Rights to discuss the issue. But when asked for comment, Minister of Justice and Human Rights, Andi Mattalatta said that the agreement was not between the Department and PT Sarana Rekataman. "The agreement was with the cooperative," said Mattalatta when contacted by VIVAnews, Sunday, Jan. 25.
