Regulation on Anti-Corruption Court Needed

VIVAnews - The due date for issuing a Law on Anti-corruption Court as mandated by the Constitutional Court is nearing. Indonesia Corruption Watch and Jakarta Legal Aid Institute request the government to prepare Government Regulation in Lieu of Law (Perpu).

Both NGOs are pessimistic that the political parties in the parliamentary could issue Law on Anti-corruption Court on time. Based on verdict of the Constitutional Court on 19 December 2006, the due date for issuing the Law is 19 December 2009.

"The Constitutional Court actually stresses that Anti-corruption Court is extremely needed and it will be constitutional if it is legalized by a statute," the joint press release of both NGOs stated on Monday, Feb 9.

The hope the people put on Anti-corruption Court is due to a disappointment at Public Courts whose annual rate of acquittal verdicts is high.

Between 2005 and 2008, there are an estimated 1421 defendants at the corruption court. 600 of them were acquitted. Around 300 defendants were sentenced to less than two years of imprisonment. "This phenomenon will certainly cause low deterrence effect on corruption," he said.

In addition, sentiments to dismiss Anti-corruption Court and bring back the court session to Public Court is contrary to the verdict issued by the Constitutional Court. In addition to maintaining the Anti-corruption Court, both NGOs expect President Susilo Bambang Yudhoyono to issue Governmental Regulation in Lieu of Law on Anti-corruption Court.
