Suit Against Carrefour Filed

VIVAnews - Market share of PT Carrefour Indonesia skyrocketed after it acquired PT Alfa Retailindo (Alfa) from 44.72 percent to 66.73 percent. Business Competition Supervisory Commission (KPPU) has officially filed a lawsuit on March 31, 2009, against Carrefour after the company allegedly committed monopoly in retail business.

"The upstream market share is more than 50 percent. It has been sharply increased," said KPPU Director of Communications, A Junaidi, on Thursday, April 2. Meanwhile, the downstream retail market of Carrefour rose from 37.98 percent to 48.38 percent.

Based on the two market criteria, PT Carrefour Indonesia was suspected of violating Law No.5/1999 on Prohibition of Monopoly and Poor Business Competition.

According to Junaidi, the case was reported on March 11 and filed on March 31. Afterwards, the case will be examined in 30 days during April. The report was early indication of Carrefour's violation against article 17 section (1) juncto article 25 of Law No.5/2009.

The investigation team comprises Dedie S Martadisastra, Tadjuddin Noer Said and Sukarmi. They will deal with the case through a preliminary investigation process scheduled as reaching its final day by May 12.

Junaidi said the case handling refers to commission's regulation No.1/2006 on Guidelines of Case Handling. Earlier, alleged case of Carrefour's monopoly was attached in Verdict No.2/KPPU-L/2005.
