VIVAnews - The Constitutional Court has again held the judicial review of Article 46, section 3C of Law No. 32/2002 on Broadcasting, the principle basis of cigarette commercials. The plaintiff demanded that cigarette commercials are banned. However, an Indonesian theater actor Butet Kertaradjasa has a different opinion.
According to Kertaradjasa, the cigarette producers have carried out real actions in the the realms of arts and culture. If they are not allowed to run the commercials, it would threaten the sustainability of the fields as such.
“Among many corporations, cigarette producers have played the biggest role in supporting art performances as well as cultural events”, Kertaradjasa said in his testimonials. He became a witness representing the government during the judicial review on Tuesday, April 28.
He said the government has not given sufficient contributions towards the development of art and culture. Therefore, sponsorships, which were given by the cigarette producers, played an important role in supporting the lives of the artists and cultural workers.
He went on to say that if the sponsorship is to be slashed, it will put away creative people. “It is like amputating our legs” he said.
He further said that if the corporations, which have been supporting the artists, are being threatened, there must be another corporation that is able to substitute the role. He asked the government to guarantee the sustainability of the artists and cultural workers if the cigarette producers are banned from making advertisement. “The government has to find alternative sponsorships”, he said.
The judicial review is filed by the National Children Protection Commission, the Children Protection Agency (LPA) for the West Java province, and two Indonesian children, Alfie and Faza.
The National Children Commissions demanded the phrase ‘Business commercials are not allowed to promote cigarettes which display the physical features of the cigarettes’ to be removed. If the Constitutional Court gives approval, cigarette ads in the media will be banned.
