Domestic Abuse Cases Increased

VIVAnews - The view that women are second-class citizens still hinders the completion of domestic abuse cases. It is deemed legal discrimination against women as victims or even perpetrators of the abuse.

"For instance, when a woman is named suspect, the motive as to why she commits the abuse is not asked. While, when a woman becomes victim, it is considered as normal," said Coordinator of Public Services at Association of Indonesian Women for Justice's Legal Aid (LBH APIK) of Jakarta Sri Nurherawati on Wednesday, Dec 31.

Nurherawati regretted that the discrimination against women still continues. In addition to discrimination, the handling of domestic abuse cases that does not apply legal analyses which are not gender-biased has become an obstacle. "Law on Domestic Abuse Abolition which is lex specialis is yet to be comprehended," said Nurherawati.

According to LBH APIK Director Estu Rakhmi Fanani, advocacy for victims of domestic abuse who undergo legal processes has not been very successful. Societal norms, public figures and threats from perpetrators, among other factors, have hampered the advocacy. "Many said that advocates have complicated matters," said Fanani.

In 2008, LBH APIK received 254 reports on domestic abuse occurring in Jakarta and surrounding areas. This is an increase of 216 cases compared to 2007.

According to LBH APIK's data, the those who file reports have normally suffered from more than one incident of domestic abuse. Almost all experienced psychological violence such as curses, polygamy and affairs. In addition, the they have also been subjected to physical violence like fist blows as well as forced sexual intercourse.

"Acts of violence that women suffer are an evidence that the government has failed in protecting women," said Nurherawati.

The domestic abuse cases were mostly committed on women between 36 and 45 years of age. Nurherawati denied that domestic abuse was mostly committed to women having low educational background and income. "Most cases occurred to scholars and families whose income is between Rp 1 million and Rp 5 million," said Nurherawati.
